This Privacy Policy describes how FINCHER INC (“Fncher,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with the Fncher platform, website (fncher.com), and related services (the “Service”).

By using the Service, creating an account, or submitting information (including through open house sign-in forms), you agree to the practices described in this Privacy Policy and our Terms of Service.

Fncher is an open house marketplace. We collect information to let agents post open houses, request and book open houses, accept bookings, submit work reports, and use the related tools. We do not collect payment card numbers, bank account numbers, Stripe Connect account data, credit balances, or payout information, because the Service does not sell credits, offer subscriptions, or pay out funds.

1. Information We Collect

1.1 Information You Provide Directly

• Account Information: Full name, email address, phone number, physical address, age, years of experience, and profile picture.
• Professional & License Information: Real estate license number, license jurisdiction, and related professional profile details you choose to provide. We may request proof of licensure to confirm eligibility. Any government-issued ID or license image submitted for verification is used solely for that review and is permanently deleted after the review is completed.
• Open House Content: Property addresses, listing links, descriptions, private instructions, emergency contact phone numbers, proof photos, and work report notes.
• Visitor Sign-In Information: Name, phone number, email address, intent (buy / sell / both / browsing), timeline, and whether the visitor is already working with a real estate agent.

1.2 Information Collected Automatically

• Device and browser information, IP address, and approximate location.
• Usage data, log data, and analytics about how you interact with the Service.
• Location data derived from addresses you submit (used for distance-based open house matching and timezone calculations).

1.3 Account Discipline Data

We collect and store a flags counter, ban status, ban expiration dates, last flag reason, and related system logs for the purpose of enforcing our automated reputation and discipline system. This information is used solely to protect the platform and is not sold or shared with third parties except as required by law or to enforce our Terms of Service.

2. How We Use Your Information

We use the information we collect to:

• Provide, operate, maintain, and improve the Service;
• Create and manage user accounts;
• Confirm eligibility and, when necessary, verify real estate licensure;
• Enable open house posting, requesting, booking, accepting, reporting, lead capture, and related tools;
• Send transactional emails, notifications, reminder emails, and (when enabled) auto follow-up emails;
• Enforce our Terms of Service and the automated reputation / discipline system;
• Protect the safety and integrity of the platform;
• Comply with legal obligations and respond to lawful requests.

Auto Follow-up Emails

Auto follow-up emails are free. When a host turns this feature on, Fncher sends one thank-you email on the host’s behalf to each eligible visitor who signed in at that open house. One email is sent per lead. Only the host can send these emails. Guest-agent reports cannot trigger them. These emails are sent only to visitors who indicated they are not already working with a real estate agent. The contact information used is the information the visitor voluntarily provided when signing in. Hosts can turn this feature off at any time.

3. How We Share Information

We do not sell personal information. We share information only in the following limited circumstances:

• With the Hosting Agent: Full visitor contact details are shared with the agent who hosted the open house so they can follow up.
• With the Listing Agent (when different): Limited information may be shared when relevant to the property.
• Lead Privacy Rule: If a visitor indicates they are already working with a real estate agent, their phone number and email address are hidden from all agents on the platform.
• Guest Agent Reports: When a guest agent hosts an open house, the listing agent receives a copy of the work report, but visitor contact details remain private to the host.
• Service Providers: We use trusted third-party providers (including Firebase, Resend, Cloudflare, and Google Cloud) to operate the Service, including hosting, authentication, and email delivery. These providers process data only as necessary to perform services on our behalf and are contractually obligated to protect it.
• Legal Requirements: We may disclose information if required by law, legal process, or governmental request, or to protect the rights, safety, or property of Fncher, our users, or others.

4. Data Retention

• Account information is retained for as long as your account remains active.
• Government ID or license images submitted for verification are permanently deleted after the review is completed.
• Work reports and associated lead data are retained so agents can access their historical records.
• Discipline records (flags, ban status, last flag reason, and related logs) are retained to maintain the integrity of the reputation system.
• You may request deletion of your account and associated data by contacting us. We will honor such requests subject to any legal retention obligations.

5. Your Rights and Choices

Depending on your location, you may have the right to:

• Access the personal information we hold about you;
• Request correction of inaccurate information;
• Request deletion of your account and data;
• Opt out of certain communications.

6. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, or alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Children’s Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected such information, we will take steps to delete it.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the revised version on this page and update the “Last Updated” date. Material changes will be communicated via email or in-app notice when reasonably practicable. Your continued use of the Service after the effective date constitutes acceptance of the updated Privacy Policy.
