Privacy Policy

This Privacy Policy describes how FINCHER INC (“Fncher,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with the Fncher platform, website (fncher.com), and related services (the “Service”).

By using the Service, creating an account, or submitting information (including through open house sign-in forms), you agree to the practices described in this Privacy Policy and our Terms of Service.

1. Information We Collect

1.1 Information You Provide Directly

  • Account Information: Full name, email address, phone number, physical address, age, years of experience, and profile picture.
  • Professional & License Information: For brokers – broker license number, license jurisdiction, brokerage name, and a photo of a government-issued ID or broker license (used solely for verification and permanently deleted after the application is approved or rejected).
  • Brokerage Join Code: Agents join a brokerage by entering a join code issued by an approved broker.
  • Open House Content: Property addresses, listing links, descriptions, private instructions, emergency contact phone numbers, proof photos, and work report notes.
  • Visitor Sign-In Information: Name, phone number, email address, intent (buy / sell / both / browsing), timeline, and whether the visitor is already working with a real estate agent.
  • Payment Information: Processed securely by Stripe. We do not store full credit card numbers on our servers.
  • Payout / Stripe Connect Information: If you enable cash-out, Stripe collects identity, bank account, and tax information required for Connect Express onboarding and payouts. Fncher stores your Stripe connected account ID and connection status; full bank and government ID details are handled by Stripe.

1.2 Information Collected Automatically

  • Device and browser information, IP address, and approximate location.
  • Usage data, log data, and analytics about how you interact with the Service.
  • Location data derived from addresses you submit (used for distance-based open house matching and timezone calculations).
  • Credit balances (total Fncher Credits and cashable credits), cash-out history, and related transaction metadata needed to operate the credit and payout system.

1.3 Account Discipline Data

We collect and store a flags counter, ban status, ban expiration dates, last flag reason, and related system logs for the purpose of enforcing our automated reputation and discipline system. This information is used solely to protect the platform and is not sold or shared with third parties except as required by law or to enforce our Terms of Service.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, maintain, and improve the Service;
  • Create and manage user accounts;
  • Verify broker identities and process brokerage affiliations;
  • Enable open house posting, booking, reporting, lead capture, and related features;
  • Process payments, manage subscriptions, handle credit purchases and spends, and process cash-outs;
  • Maintain total and cashable credit balances and enforce cash-out eligibility rules;
  • Send transactional emails, notifications, and (when enabled) Auto Follow-up Emails;
  • Enforce our Terms of Service and the automated reputation / discipline system;
  • Protect the safety and integrity of the platform;
  • Comply with legal obligations (including tax reporting where applicable) and respond to lawful requests.

Auto Follow-up Emails

Agents may optionally enable Auto Follow-up Emails. When this feature is turned on, Fncher automatically sends a one-time thank-you email on the agent’s behalf to visitors who signed in at an open house, approximately two hours after the open house ends. These emails are only sent to visitors who indicated they are not already working with a real estate agent. Each email consumes Fncher Credits from the agent’s balance. The contact information used is the information the visitor voluntarily provided when signing in.

Cash Out / Payouts

If you use cash-out, we use your account identifiers, cashable credit balance, and Stripe Connect account status to initiate transfers through Stripe. Stripe processes the underlying bank and identity verification. Fncher does not store your full bank account numbers.

3. How We Share Information

We do not sell personal information. We share information only in the following limited circumstances:

  • With the Hosting Agent: Full visitor contact details are shared with the agent who hosted the open house so they can follow up.
  • With the Listing Agent (when different): Limited information may be shared when relevant to the property.
  • Lead Privacy Rule: If a visitor indicates they are already working with a real estate agent, their phone number and email address are hidden from all agents on the platform.
  • Guest Agent Reports: When a guest agent hosts an open house, the listing agent receives a copy of the work report, but visitor contact details remain private to the host.
  • Associated Brokerage: Agent profile information, performance metrics (including open houses completed and leads captured), badges, and credit activity are accessible to the brokerage with which the agent is affiliated. Brokers may view aggregated team analytics and disburse credits to their agents.
  • Service Providers: We use trusted third-party providers (including Firebase, Stripe, Resend, Cloudflare, and Google Cloud) to operate the Service. Stripe processes payments, subscriptions, and cash-out transfers (including Connect onboarding). These providers process data only as necessary to perform services on our behalf and are contractually obligated to protect it.
  • Legal Requirements: We may disclose information if required by law, legal process, or governmental request (including tax authorities), or to protect the rights, safety, or property of Fncher, our users, or others.

4. Data Retention

  • Account information is retained for as long as your account remains active.
  • Government ID images uploaded by broker applicants are permanently deleted after the application is approved or rejected.
  • Work reports and associated lead data are retained so agents can access their historical records.
  • Credit balances, cash-out records, and related transaction logs are retained as needed to operate the Service, prevent fraud, and meet accounting or tax obligations.
  • Discipline records (flags, ban status, last flag reason, and related logs) are retained to maintain the integrity of the reputation system.
  • You may request deletion of your account and associated data by contacting us. We will honor such requests subject to any legal retention obligations (including records related to payments and payouts).

5. Your Rights and Choices

Depending on your location, you may have the right to:

  • Access the personal information we hold about you;
  • Request correction of inaccurate information;
  • Request deletion of your account and data;
  • Opt out of certain communications.

To exercise these rights, contact us at contactfncher@gmail.com. Agents can enable or disable Auto Follow-up Emails at any time from the My Reports page. Cash-out and Stripe Connect settings can be managed from the Cash Out page and through Stripe’s interfaces where applicable.

6. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, or alteration. Payment and payout data is handled by Stripe under their security controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Children’s Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected such information, we will take steps to delete it.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the revised version on this page and update the “Last Updated” date. Material changes will be communicated via email or in-app notice when reasonably practicable. Your continued use of the Service after the effective date constitutes acceptance of the updated Privacy Policy.
