Terms of Service
Welcome to Fncher ("Fncher," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Fncher website (fncher.com), platform, mobile applications, and services (collectively, the "Service").
by accessing or using the service, or by clicking "i accept" or similar during signup, you agree to be bound by these terms. if you do not agree, you may not use the service. these terms incorporate our Privacy Policy by reference.
1. Eligibility
The Service is available only to licensed real estate agents and brokers in the United States who are at least 18 years old. You must provide accurate license information and pass our mandatory verification process (including submission of a government-issued ID image and official state license profile URL). Only users who are approved by Fncher may become active users.
2. Account Registration and Verification
You must create an account using Firebase Authentication. During signup you will:
- Provide your full legal name, email, physical address, geolocation (lat/lng), state, real estate license number, and official license profile URL.
- Upload a clear photo of your government-issued ID or driver’s license.
- Accept these Terms.
Your application will be placed in a "pending" status. Fncher admins will review your submission. We may approve or reject your application at our sole discretion. If rejected, your account and all uploaded data (including the ID image) will be permanently deleted. If approved, you will receive 200 Fncher Credits and full access.
You agree to keep your license information current. If your license becomes inactive, suspended, or revoked, you must immediately notify us and we may suspend or terminate your account.
3. Open Houses and Marketplace
Fncher provides a technology platform that connects licensed real estate agents for open house postings, requests, bookings, and reporting. Fncher is not a real estate broker, does not list properties for sale, does not provide real estate advice, and is not responsible for the accuracy, legality, or condition of any property, open house, or related activity.
Posting an open house is subject to strict limits (1 open house at a time for standard users, 3 for FncherOne subscribers). Booking a request costs 100 Fncher Credits. You must obtain express seller permission before posting any property. All listing links must come from approved MLS or brokerage domains. By posting, you represent and warrant that you have full authority from the seller and that all information provided (including private instructions, emergency contact numbers, and access codes) is accurate.
Visitors may self-check-in at open houses via a public form. You consent to the collection and sharing of this visitor data as described in our Privacy Policy.
After hosting, you must submit a work report including notes and up to 5 photos. Private open house data is shared only with the confirmed booking agent and is automatically limited in scope.
4. Fncher Credits, FncherOne, and Payments
Approved agents receive an initial 200 Fncher Credits. Credits are used for open house bookings and other premium features. Credits have no cash value and are non-transferable except as explicitly allowed by Fncher. All credits and subscriptions are non-refundable except as required by law.
FncherOne is a paid subscription that increases open house posting limits and unlocks additional benefits. Credit packs may be purchased via Stripe. All payments are processed through Stripe. You authorize us to charge the payment method associated with your Stripe account.
Stripe Connect accounts allow agents to receive payouts for services. You are responsible for complying with all tax and legal obligations related to any payments you receive.
5. Broker Accounts and Brokerages
Brokerages may apply for a broker account. Approved brokers receive a unique join code. Agents may join or leave brokerages (limited to once every 30 days). Brokers are responsible for the conduct of agents they invite. Certain agent data is automatically synced to the brokerage subcollection.
6. User Conduct
You agree to use the Service only for lawful purposes and in compliance with all applicable real estate laws (including the Fair Housing Act). You may not:
- Provide false or misleading information during verification or posting.
- Post open houses without express seller permission.
- Upload content that violates any law or third-party rights.
- Attempt to circumvent credit costs, posting limits, or verification.
- Use the Service to engage in any form of spam, harassment, or illegal activity.
7. Intellectual Property
Fncher and its logos, designs, and software are our exclusive property. You are granted a limited, non-exclusive, non-transferable license to use the Service during your active account period.
8. User-Generated Content
You retain ownership of any content you upload or post (including open house listings, private instructions, photos, and reports). By posting content to the Service, you grant Fncher a worldwide, royalty-free, non-exclusive, transferable license to host, display, reproduce, modify (for formatting), and distribute that content solely as needed to operate and promote the Service.
9. Indemnification
You agree to indemnify, defend, and hold harmless Fncher, its officers, directors, employees, agents, and affiliates from any and all claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your violation of these Terms or any law; (ii) your open house postings, private instructions, emergency contact sharing, or any real estate activity; (iii) any content you upload or any seller permission issues; (iv) any claims by visitors, sellers, buyers, or third parties related to your use of the Service; or (v) your breach of any third-party rights.
10. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY OPEN HOUSE INFORMATION, PRIVATE INSTRUCTIONS, LISTINGS, OR LICENSE INFORMATION. Fncher is a technology platform only and is not a real estate broker, does not verify properties, does not guarantee seller permission, and is not responsible for the actions of agents, brokers, visitors, or any property-related incidents, damage, theft, injury, or disputes.
IN NO EVENT SHALL FNCHER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim (or $100 if you have not paid anything).
11. Termination
We may suspend or terminate your account at any time, with or without cause, including if you violate these Terms or your real estate license becomes invalid. Upon termination, your right to use the Service ceases immediately. Credits are non-refundable. Sections that by their nature should survive will survive termination.
12. Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Atlanta, Georgia.
13. Changes to Terms
We may update these Terms at any time. We will notify you by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
