BETA NOTICE
Fncher is currently in beta. Features, credit mechanics, pricing, limits, review systems, and functionality may change at any time without prior notice. By using the Service during beta, you accept that the platform is evolving and that purchases made during this period remain subject to the non-refundable policies described below.
Welcome to Fncher ("Fncher," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Fncher website (fncher.com), platform, mobile applications, and services (collectively, the "Service").
By accessing or using the Service, or by clicking "I accept" or similar during signup or form submission, you agree to be bound by these Terms. If you do not agree, you may not use the Service. These Terms incorporate our Privacy Policy by reference.
1. Eligibility and Application Review
The Service is available only to licensed real estate agents and brokers in the United States who are at least 18 years old. You must provide accurate license information and pass our mandatory verification process, which includes submission of a government-issued ID image and an official state license profile URL.
All applications are subject to manual review by Fncher administrators. We reserve the sole discretion to approve or reject any application. If your application is rejected, your account and all associated data (including your uploaded ID image) will be permanently deleted, and you will receive notification by email.
2. Account Registration and Verification
You must create an account using Firebase Authentication. During signup you will provide your full legal name, email, physical address, geolocation, state, real estate license number, official license profile URL, and upload a clear photo of your government-issued ID.
Approved agents start with 0 Fncher Credits. Credits must be earned through platform activity (such as submitting work reports) or purchased via credit packs.
3. Open Houses and Marketplace
Fncher provides a technology platform that connects licensed real estate agents for open house postings, requests, bookings, and reporting. Fncher is not a real estate broker, does not list properties for sale, does not provide real estate advice, and is not responsible for the accuracy, legality, or condition of any property or open house. All agents are independent contractors and not employees or agents of Fncher.
You must obtain express seller permission before posting any property. By posting, you represent and warrant that you have full authority from the seller and that the posting complies with all applicable real estate laws, advertising regulations, and MLS rules in your jurisdiction.
Posting limits apply (1 open house at a time for standard users, 3 for FncherOne subscribers). You may optionally spend Fncher Credits on a promotion boost for your open house. A portion of spent promotion credits becomes a visible boost attached to that open house. Promotion credits spent on open houses that are later deleted while still in "open" status are refunded to your balance.
Visitors may self-check-in at open houses via a public form. After hosting, you must submit a work report (including notes and up to 5 photos). Proof photos can only be uploaded after the open house start time. Reports can only be submitted after the open house end time.
Visitor Sign-In by Members of the Public
Open house sign-in forms are available to the general public. Visitors who use these forms are not required to create an account and are not agents on the Fncher platform. By completing and submitting the sign-in form and affirmatively accepting these Terms of Service and Privacy Policy, the visitor agrees that:
- Their full name, email address (if provided), phone number, stated intent (buy, sell, both, or browsing), and any notes or questions may be shared with the hosting agent and the original listing/posting agent (if different); and
- This information will be retained inside the work report for that open house so the agent(s) can follow up with the visitor regarding the property or related real estate services.
Fncher does not sell visitor data. The purpose of the public sign-in form is to generate usable leads for licensed real estate agents to follow up with interested members of the public.
4. Work Reports and Reviews
Hosting agents and guest agents who complete work reports may leave good or bad reviews on those reports. These reviews affect the visible review counts on agent profiles. Submitting false, abusive, or retaliatory reviews is strictly prohibited and may result in account suspension or termination.
5. Fncher Credits, FncherOne, and Payments
ALL CREDIT AND SUBSCRIPTION PURCHASES ARE FINAL — NO REFUNDS
Fncher Credits are virtual credits that have no cash value, are non-transferable, and may only be used to access features and promotions within the Service. Credit packs purchased through the Service (including any future in-app purchases) are digital products.
ALL SALES OF FNCHER CREDITS AND CREDIT PACKS ARE FINAL AND NON-REFUNDABLE. No refunds, exchanges, or credits will be issued for any reason except:
- The limited promotion credit refund for deleted open houses as expressly described in Section 3, or
- Where a refund is strictly required by applicable law.
FncherOne is a recurring monthly subscription. You may cancel your FncherOne subscription at any time through your account settings. Upon cancellation, you will retain full access to FncherOne benefits until the end of your current paid billing period. No prorated refunds, partial credits, or compensation will be provided for cancellations or for any unused portion of a billing period.
By completing any purchase of Fncher Credits, credit packs, or a FncherOne subscription, you expressly acknowledge and agree that you are purchasing digital access and virtual items, and you waive any claim to refunds except as expressly provided in these Terms or required by law.
We reserve the right to expire unused Fncher Credits on any account that has been inactive for twelve (12) or more consecutive months. Expired credits will not be restored.
All payments are processed securely by Stripe, Inc. You agree to Stripe’s Terms of Service and Privacy Policy in addition to these Terms. You are solely responsible for all taxes, reporting, and compliance obligations related to any payments made or received through the Service, including any required 1099 forms or state tax filings.
6. Broker Accounts and Brokerages
Brokerages may apply for approval. Approved brokers receive a unique join code. Agents may join or leave brokerages (subject to timing limits). Brokers are responsible for the conduct of agents they invite.
7. User Conduct
You agree to use the Service only for lawful purposes and in full compliance with all applicable real estate licensing laws, advertising regulations, fair housing laws, and MLS rules in your jurisdiction. You are solely responsible for ensuring that every open house posting, photo, description, and communication complies with local laws.
You may not provide false information, post without express seller permission, circumvent limits or credit systems, submit abusive reviews, or engage in spam, harassment, or illegal activity.
8. Prohibited Conduct
In addition to the above, you may not:
- Upload false, misleading, or manipulated photos or reports
- Use the platform to circumvent any real estate licensing, advertising, or fair housing laws
- Attempt to reverse engineer, scrape, or interfere with the Service
- Create multiple accounts to evade limits, reviews, or credit systems
- Harass, threaten, or abuse other users or Fncher staff
9. Intellectual Property
Fncher and its logos, designs, and software are our exclusive property. You are granted a limited license to use the Service during your active account period.
10. User-Generated Content
You retain ownership of content you upload. By posting, you grant Fncher a worldwide, royalty-free license to host, display, and distribute that content as needed to operate the Service.
11. DMCA Copyright Policy
If you believe any content on the Service infringes your copyright, please send a DMCA notice to contactfncher@gmail.com with the required information under 17 U.S.C. § 512. We will respond to valid notices and may remove or disable access to allegedly infringing material.
12. Indemnification
You agree to indemnify and hold harmless Fncher and its officers, directors, employees, and agents from any claims, losses, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your open house activities, reviews, content, or violation of these Terms.
13. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES REGARDING ACCURACY OF OPEN HOUSE INFORMATION, PRIVATE INSTRUCTIONS, PROMOTION BOOSTS, OR REVIEWS. Fncher is a technology platform only and is not responsible for the actions of agents, brokers, visitors, property incidents, or disputes.
IN NO EVENT SHALL FNCHER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the amount you paid us in the twelve months preceding any claim (or $100 if you have paid nothing).
14. Termination
We may suspend or terminate your account at any time, with or without cause. Upon termination or suspension, your right to use the Service ends immediately. Any remaining Fncher Credits are forfeited and non-refundable except as expressly provided in these Terms. You will not receive any refund for prepaid subscription periods.
15. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in Atlanta, Georgia, under the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action. The arbitrator’s decision shall be final and binding.
16. Governing Law
These Terms are governed by the laws of the State of Georgia. Any dispute shall be resolved exclusively in the state or federal courts located in Atlanta, Georgia, except as provided in the arbitration section above.
17. Changes to Terms
We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes affecting payments or refunds will be communicated via email or in-app notice where reasonably possible.
